Privacy Policy for the Acemagic Website

This Privacy Policy applies to Acemagic.com and all other websites, applications, products, services, and other offerings (collectively, the “Products”) that are owned and operated by Acemagic Inc. and our affiliates and subsidiaries (“Acemagic”).

This Privacy Policy explains how Acemagic collects, uses, and discloses personal data that we obtain through the Products, your communications with us, or from third parties. It also describes your choices and rights regarding your personal data.

We collect personal data under the following circumstances:

• Account Registration: For some of our Products, you may choose to create an account. If you choose to register, you will provide us with certain personal data such as your username and password. Registration is not mandatory to use our Products.
• Purchasing an Acemagic Product: When you make a purchase, you may log into an account or continue as a guest. In either case, when purchasing an Acemagic product you provide us with personal data such as your name, email address, payment information, and shipping address.
• Payment: When you make a payment to Acemagic, you may share personal information with our third-party payment providers. This information may include sensitive data such as your credit card number.
• Submitting Information to Us: We collect the information you submit to us. For example, when you post product reviews on Acemagic.com or recommend our products to friends through Acemagic.com, we receive the information you submit, including any personal data. If you choose to publish content in the public areas of Acemagic.com, that content will be considered “public” and will not be protected by this Privacy Policy.
• Communicating with Us: When you contact us, we may collect personal data from you. For example, this may occur when you send us an email, call customer service, subscribe to the Acemagic newsletter, or make a reservation for an event hosted by Acemagic.
• Participating in Surveys: From time to time, we may ask you to participate in optional online surveys. If you choose to participate, you may be asked to provide certain information, including personal data.
• Data About Third Parties: If you use our referral service to recommend Acemagic to a friend, we may collect your friend’s personal data, such as their name and email address. We will send your friend a one-time email inviting them to purchase an Acemagic product. We store your friend’s information only to send this one-time email and to track the success of our referral program.
• Passive Data Collection: Our websites and applications automatically collect certain information when you use them, such as your preferences and anonymous usage statistics. This information may include Internet Protocol addresses (IP addresses), cookie identifiers, browser type, Internet service provider (ISP), referring/exit pages, files viewed on our websites and applications (e.g., HTML pages, graphics), and system and date/time stamps. These data are used to analyze general trends and administer our Products. Passively collected information may be combined with other data about you, including personal data, when you are logged into your Acemagic account.
• Tracking Technologies: Acemagic and our partners use cookies, pixels, server logs, and similar technologies to analyze trends, administer the website, track users’ movements around the site, and gather demographic information about our user base. The non-personal data we collect using these technologies may be combined with other data about you, including personal data, when you are logged into your Acemagic account.
• Third-Party Data: Acemagic may collect data about you from third parties or supplement the data you provide with additional datasets obtained from third parties. If you place an order with a third-party retailer, that retailer will send your personal data to Acemagic to fulfill your order. We also collect data from third parties to improve our services, provide better customer service, customize our content to your needs, and offer information that may be of interest to you.

Non-personal data collected when using our Products. Some of our Products may collect data when you use them. For example, if you use our Glow light and the associated application, we collect information about your Glow usage, such as whether you turn it on or off, adjust brightness, your device type, and information about the lighting conditions in your location in order to provide appropriate settings (collectively, “Glow Usage Data”). Glow and the associated app do not collect any personal data other than your Internet Protocol address.

How does Acemagic use your data?

Unless otherwise stated, we do not share your personal data. We will never use your data for personal gain; we use your information to continue developing high-quality products and to optimize your experience with relevant offers and promotions.

We use personal data as follows:

1. Internal and service-related use: We use and store information, including personal data, to improve and facilitate our Products, including:

• Analyzing interactions with and performance of our Products;
• Debugging and identifying errors that impair functionality;
• Detecting security incidents and protecting against malicious, deceptive, fraudulent, or illegal activities;
• Conducting research related to technological development and demonstration;
• Improving or enhancing our Products or our website.

2. Advertising: We may use personal data to deliver targeted advertising, including direct marketing to consumers and through unaffiliated advertising partners, to measure the effectiveness of advertisements on behalf of our advertising partners and identify audiences most likely to respond to an advertisement.

3. Communication: We may send emails to the email address you provide to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance.

4. Marketing: We may use information about you, including personal data, to send you information about Acemagic products.

5. Non-personal data: We may use aggregated or other data that is not personal data for any purpose, including marketing. These purposes include analyzing interactions with and the performance of our Products to improve them, and sharing such information with our business partners, affiliates, or other third parties. In addition, we may supplement such aggregated data collected through our Products with other information obtained from our business partners.

How do we use automatic data collection technologies?

We and third parties that provide content, advertising, or other features on our Products use cookies, pixel tags, local storage, and other technologies to automatically collect information. The use of these technologies falls into the following general categories:

• Required for functionality: These technologies allow you to access our Products and are necessary to maintain functionality and monitor and protect our Products.
• Performance-related: These technologies help us evaluate the performance of our Products and understand how users and visitors interact with them.
• Functionality-related: These technologies allow us to provide you with an enhanced experience when using our Products, such as identifying you when you log in to your account or remembering your preferences.
• Advertising or targeting-related: We may use first-party or third-party technologies to deliver content, including tailored ads, that are relevant to your interests on our Products or on third-party websites and applications.

Acemagic may disclose your data as follows:

• Service Providers: We may share personal data with vendors and service providers that perform services on behalf of Acemagic. These third parties may use your personal data only as necessary to provide services to us, such as order fulfillment, payment processing, sending and improving communications, developing and improving our Products, detecting, preventing, and addressing fraud or other prohibited activities, and otherwise supporting the provision of our Products.
• Display to Other Users: Content you post on Acemagic.com may be displayed on Acemagic.com. Other users may be able to see certain information about you, such as your name if you post a review. We are not responsible for the privacy practices of other users who view and use the posted information.
• Legal Disclosure and Similar Processes: We may access, preserve, and disclose your personal data, other account information, and content if we believe doing so is required or appropriate to comply with law enforcement requests and legal processes, such as a court order, government request, or subpoena. We may also access, preserve, and disclose your personal data, other account information, and content if we believe in good faith that disclosure is necessary to protect your rights, our rights, or the rights, property, or safety of others, or to investigate fraud.
• In the Event of a Merger, Sale, or Other Asset Transfer: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, your information may be sold or transferred as part of such a transaction (as permitted by law and/or contract). The use of your personal data following such an event will be governed by the provisions of the Privacy Policy in effect at the time such personal data was collected.

We may also share your personal data with your consent.

Your Privacy Rights

You may have the following rights under applicable law:

• Access the personal data we have collected about you.
• We may provide self-service tools that allow you to correct this information.
• Request the deletion of personal data that we have stored.
• Request restrictions on processing or object to processing, including the right to opt out of the sale of your personal data to third parties.

You may send an email to service@acemagic.com. We will respond to your request within a reasonable timeframe. We reserve the right to retain transaction data where necessary to comply with legal obligations or for legitimate business purposes.

• Shine the Light. Under California’s “Shine the Light” law, you may have the right once per year to request from us, free of charge, a list of third parties to whom we disclosed personal data for their direct marketing purposes in the preceding calendar year, along with the categories of personal data disclosed to those parties.
• Cookies. You can stop or restrict the placement of cookies on your computer or remove them from your browser by adjusting your web browser settings. Please note that cookie-based opt-outs are not effective on mobile applications. However, on many mobile devices, application users may opt out of certain mobile advertising through their device settings.
• Advertising. To manage our advertising on other websites, we work with third-party advertising partners. These partners may use technologies such as cookies to collect information about your activities on Acemagic.com and other websites to provide you with advertising based on your browsing activities and interests. Notwithstanding the foregoing, our third-party advertising partners do not have access to or share Glow Usage Data with such third parties. Some of our third-party advertising partners participate in self-regulatory organizations that operate websites where you can opt out of receiving targeted ads from these partners. You can visit these sites and learn more about targeted advertising and consumer choice at Network Advertising or AboutAds. You can also choose not to be included in Google Analytics.

For clarity: whether you opt out by adjusting your browser/device settings or by using a website established by a self-regulatory group, these cookie-based opt-outs must be performed on each device and browser for which you want the opt-out to apply. For example, if you opt out in your computer browser, that opt-out will not be effective on your mobile device. You must opt out separately on each device.

Do Not Track mechanisms. Please note that we do not respond to or honor “Do Not Track” signals or similar mechanisms transmitted by web browsers.

Email. If you receive an unwanted email from us, you can use the unsubscribe link at the bottom of the email to opt out of receiving future emails. We will process your request within a reasonable time after receipt. We are not responsible for removing your personal data from the lists of third parties who previously received your information in accordance with this policy.

Websites and Social Media

Our Products may contain links to other websites, and other websites may reference or link to Acemagic.com or our other Products. These other domains and websites are not under our control. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve the privacy practices or content of these other websites or ap
